NO WAITING PERIOD FOR MUTUAL CONSENT DIVORCE?

Many people ask me if the August,2016 order of the Supreme Court of India is applicable to all the cases of  divorce by mutual consent so that the statutory waiting period of 6 months from the date of filing the petition can be waived. It is not so. The Supreme Court has clearly stated that its order is not a case law to be followed for future cases to waive such period and only Supreme court has power to do so under Article 142 of the Constitution of India.
